Terms of Service

Please read these Terms of Service ("Terms") carefully before using our Service. These Terms form a binding agreement between You and BuildMyPOD and govern Your access to and use of the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.

You represent that You are at least 18 years old and have the authority to bind Yourself and, if applicable, the entity You represent.

Your use of the Service is also governed by our Privacy Policy, which explains how We collect and use personal data. Please review it carefully before using the Service.

1) Interpretation and Definitions

Interpretation

Capitalized terms have the meanings assigned here. The same meanings apply whether terms appear in singular or plural.

Definitions

For purposes of these Terms:

  • "Account" means a unique account created for You to access the Service.
  • "Affiliate" means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other voting securities.
  • "Application" means the BuildMyPOD Shopify application that connects to Your Shopify store.
  • "Company," "We," "Us," "Our" means BuildMyPOD.
  • "Content" means any information, data, text, images, videos, product listings, artwork, designs, or materials uploaded, submitted, generated, or otherwise provided by You through the Service.
  • "Device" means any device that can access the Service (e.g., computer, phone, tablet).
  • "Documentation" means any guides, tutorials, or training materials We provide.
  • "Service" means the Application, related websites and dashboards, training portal, and any associated features, products, or services provided by BuildMyPOD.
  • "Shopify" means the platform and services provided by Shopify Inc. and its affiliates.
  • "Third-Party Services" means services, products, software, or websites operated by third parties, including Shopify, Printify, Printful, Google Analytics, and Facebook/Meta Pixel, that may be integrated with or accessible via the Service.
  • "You" means the individual using the Service or the organization on whose behalf that individual uses the Service.

2) Service Overview & Scope

BuildMyPOD is a Shopify application that helps merchants create print-on-demand e-commerce stores. Core features include automated store setup, product publishing, design/mockup tools, training/course access, and integrations with print-on-demand fulfillment providers You choose to connect (e.g., Printify, Printful).

BuildMyPOD is not a manufacturer or shipper and is not the seller of record for Your store. Physical product fulfillment is handled solely by Your chosen providers and/or Shopify. The Service is designed not to store or process Your end-customer orders or payment card data.

We may update, modify, or discontinue features from time to time. Where feasible, We will give reasonable advance notice of material changes.

3) Accounts & Eligibility

To use certain features, You must create an Account and connect Your Shopify store. You must provide accurate, complete, and current information and keep it updated. You are responsible for safeguarding Your login credentials and for any activity under Your Account. Notify Us promptly of any unauthorized use.

You must be authorized to grant the permissions requested by the Application for the connected Shopify store.

4) Shopify Installation & Permissions

Installing the Application authorizes BuildMyPOD to access certain Shopify APIs and data according to the permissions You approve during installation. If You uninstall the Application, Our API access is revoked and We will disable related tokens and, within a reasonable time, delete or anonymize data We no longer need to provide the Service or comply with law.

Some features (e.g., publishing products, reading catalog metadata) require ongoing permissions. If permissions are revoked, functionality may be limited or unavailable.

5) Third-Party Services & Integrations

Your use of Third-Party Services is governed by those providers' terms and privacy policies. BuildMyPOD does not control and is not responsible for Third-Party Services, including their availability, security, or data practices. You are responsible for reviewing and complying with the applicable terms for Shopify, Printify, Printful, Google Analytics, Facebook/Meta, and any other providers You connect.

We may enable or recommend integrations for Your convenience, but such references do not constitute endorsements, warranties, or guarantees.

6) Your Responsibilities (Merchants)

You are solely responsible for:

  • Your store operations, product listings, pricing, taxes, shipping, returns, and end-customer communications.
  • Ensuring You have all rights necessary to upload, publish, or generate Content (including designs/mockups).
  • Compliance with applicable laws and platform policies (e.g., consumer protection, advertising, IP, privacy, content standards).
  • Reviewing and approving any AI-assisted or auto-generated outputs before publishing them to Your store.

You acknowledge that any designs, descriptions, or mockups generated by or through the Service may require human review and editing. BuildMyPOD makes no promises that outputs are accurate, non-infringing, or fit for a particular purpose.

7) Content; License to BuildMyPOD

You retain ownership of Your Content. You grant BuildMyPOD a worldwide, non-exclusive, royalty-free license to host, reproduce, process, adapt, display, and otherwise use the Content solely to provide, maintain, secure, and improve the Service (including generating mockups, publishing products, rendering previews, and providing support).

You represent and warrant that You have all necessary rights to grant the foregoing license and that Your Content does not infringe or violate any third-party rights or laws.

We may remove or disable Content that We reasonably believe violates these Terms or the law.

8) Prohibited Uses

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, infringing, or misleading purposes.
  • Upload or publish Content that is illegal, defamatory, obscene, hateful, or otherwise objectionable, or that violates others' privacy or intellectual property rights.
  • Attempt to interfere with or compromise the Service's integrity or security, including by reverse engineering, decompiling, scraping, or bypassing technical measures.
  • Misuse rate limits, API endpoints, or automated publishing in a manner that degrades Service stability.
  • Use the Service for surveillance of individuals or in a way that violates applicable privacy laws.

9) Fees, Billing & Taxes; No Refunds

Fees (including subscription fees) are typically billed via Shopify billing. By subscribing, You authorize Shopify to charge applicable fees, taxes, and any overages according to Your plan. Plan descriptions, pricing, and billing intervals are disclosed at signup or in Your Shopify Admin.

All sales are final and non-refundable to the maximum extent permitted by law. We do not issue refunds or credits for partial billing periods, unused features, or downgrades, except where required by law or expressly stated in writing. If We offer a free trial, charges begin when the trial ends unless You cancel before then.

You are responsible for all taxes, duties, and similar governmental assessments associated with Your purchases, excluding taxes based on Our net income.

10) Changes to Plans & Trials

We may offer trials, promotional plans, or beta features. Eligibility and duration are at Our discretion. We may change plan features or pricing prospectively upon notice (e.g., email, in-app, or posting on Our site). If You do not agree to a change, You must cancel before it takes effect.

11) Email & Electronic Communications

By creating an Account or using the Service, You consent to receive service-related communications (e.g., notices, security alerts) and, if You opt in, promotional communications (newsletters, offers). You can unsubscribe from promotional emails via the link in the email. Service-related notices are transactional and not subject to opt-out.

12) Intellectual Property; Training & Documentation

The Service, including software, interfaces, templates, training content, Documentation, logos, and trademarks, is owned by BuildMyPOD or its licensors and is protected by intellectual property laws. Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Documentation for Your internal business purposes.

Except where permitted by law, You may not copy, modify, distribute, sell, or lease any part of the Service or reverse engineer it. Training/course access is for the enrolled Account and may not be shared, re-published, or resold.

13) Feedback

If You provide feedback or suggestions, You grant Us a perpetual, irrevocable, worldwide, royalty-free license to use it without restriction or compensation.

14) Confidentiality

Non-public information You disclose to Us for support that is marked or reasonably understood to be confidential will be used only to provide the Service/support and safeguarded with reasonable measures. Confidentiality obligations do not apply to information that is publicly available, independently developed, or rightfully received from a third party without duty of confidentiality.

15) Privacy & Data

Our handling of personal data is described in the BuildMyPOD Privacy Policy. By using the Service, You agree to that policy. You are responsible for posting and maintaining Your own store privacy notices and for complying with applicable data protection laws with respect to Your customers.

16) Modifications to the Service

We may enhance, change, or discontinue features from time to time. If a change materially reduces core functionality You rely on, You may cancel Your subscription; any statutory remedies remain unaffected.

17) Term; Suspension; Termination

These Terms take effect when You first use the Service and continue until terminated. We may suspend or terminate access immediately, with or without notice, if (a) You breach these Terms, (b) We are required to do so by law or by a platform/provider (e.g., Shopify), or (c) We discontinue the Service.

Upon termination, Your right to use the Service ends immediately, and We may delete or anonymize data not required for legal or legitimate business purposes within a reasonable time. Sections intended to survive (including payment obligations accrued prior to termination, IP, confidentiality, disclaimers, limitations of liability, indemnities, and governing law) will survive termination.

18) "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE," with all faults and defects, without warranties of any kind. To the maximum extent permitted by law, We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, accurate, or meet Your requirements, or that errors can or will be corrected.

19) Limitation of Liability

To the maximum extent permitted by law, in no event will BuildMyPOD or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost data, business interruption, or loss of goodwill), even if advised of the possibility.

Our total liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amounts You paid to Us for the Service in the twelve (12) months preceding the event giving rise to liability, or (b) USD $100. Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.

20) Indemnification

You will defend, indemnify, and hold harmless BuildMyPOD, its Affiliates, and their respective officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content, store operations, or products; (b) Your misuse of the Service; (c) Your violation of these Terms or applicable law; or (d) Your use of Third-Party Services.

21) Export Controls & Sanctions; U.S. Legal Compliance

You represent and warrant that You are not located in, and will not use the Service from, a jurisdiction embargoed by the United States and that You are not on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.

22) Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflicts of law rules.

Before filing a claim, the parties will attempt to resolve disputes informally by contacting the other party in writing and allowing 30 days to respond. If the dispute is not resolved, the parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania, and each party waives any objection to such courts' jurisdiction and venue. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL TO THE EXTENT PERMITTED BY LAW.

23) Severability; Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the affected provision will be enforced to the maximum extent permissible. Failure to enforce any right is not a waiver of future enforcement.

24) Assignment; Subcontracting

You may not assign or transfer these Terms (by operation of law or otherwise) without Our prior written consent. We may assign these Terms or subcontract obligations in connection with a merger, acquisition, corporate reorganization, or sale of assets, or to an Affiliate.

25) Force Majeure

We will not be liable for delays or failures to perform due to events beyond Our reasonable control, including acts of God, labor disputes, internet or hosting failures, governmental actions, and third-party service interruptions.

26) Notices

We may provide notices via email, in-app messages, or by posting to Our website. Notices to BuildMyPOD must be sent to support@buildmypod.ai.

27) Entire Agreement; Order of Precedence

These Terms, together with any order forms or plan descriptions and the Privacy Policy, constitute the entire agreement between You and BuildMyPOD regarding the Service and supersede all prior or contemporaneous agreements on the subject. In case of conflict, an executed order form (if any) controls over these Terms, which control over Documentation and marketing pages.

28) Changes to These Terms

We may modify these Terms from time to time. If a revision is material, We will provide reasonable advance notice (e.g., by email, in-app notice, or posting). Changes take effect on the stated effective date. By continuing to access or use the Service after changes become effective, You agree to be bound by the revised Terms. If You do not agree, You must stop using the Service and, if applicable, uninstall the Application.
